End User License Agreement

Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you and POKER VAULT LTD for the Poker Vault software application. By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.

License Grant

POKER VAULT LTD grants you a limited, non-exclusive, non-transferable, revocable licence to use the Software solely for your personal, non-commercial purposes on Apple iOS devices that you own or control, subject to the terms of this EULA and the Apple App Store Terms of Service.

1 Use the Software

Install and use the Software on iOS devices you own or control for personal bankroll tracking purposes.

2 Access Features

Access and use all features of the application in accordance with this agreement and applicable law.

3 Export Your Data

Export your session data at any time via the native iOS share sheet in CSV format.

License Restrictions

You may NOT:

Copy, modify, or create derivative works of the Software.

Reverse engineer, decompile, or disassemble the Software.

Remove, alter, or obscure any proprietary notices on the Software.

Use the Software for any commercial purpose without authorisation.

Use automated systems to access or interact with the Software.

Interfere with or disrupt the Software or any related systems.

Use the Software in any unlawful manner or for any unlawful purpose.

Distribute, sublicence, rent, or lend the Software to any third party.

1 Intellectual Property

The Software is licensed, not sold. POKER VAULT LTD retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks, service marks, or trade names of POKER VAULT LTD.

We Own

All software code, algorithms, designs, graphics, text, and other content in the application.

You Own

Your personal session data and any user-generated content you create using the Software.

2 User Data and Privacy

Your use of the Software is governed by our Privacy Policy. Poker Vault is an offline-first application. We do not collect, store, or process your personal data on any server. All data you enter remains on your device.

We do not collect account information, training or session data remotely, device analytics, or payment information. There is no subscription or payment mechanism within the app.

3 Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POKER VAULT LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be uninterrupted, error-free, or free of defects. Poker Vault is a tracking and analytics tool and does not guarantee specific financial results or improvements to your poker game.

4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POKER VAULT LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE.

This includes, but is not limited to, damages for loss of data, business interruption, or any other commercial damages or losses, even if POKER VAULT LTD has been advised of the possibility of such damages.

5 Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term. Upon termination:

You must cease all use of the Software.
You must delete or destroy all copies of the Software in your possession.

POKER VAULT LTD may also terminate this EULA at any time by discontinuing the Software or removing it from distribution. Sections covering intellectual property, disclaimers, and limitations of liability survive termination.

6 Updates and Modifications

POKER VAULT LTD may provide updates, patches, or modifications to the Software from time to time. These updates may be delivered through the Apple App Store. You acknowledge that the Software may require such updates to continue functioning correctly.

We reserve the right to modify this EULA at any time. Continued use of the Software after changes constitutes acceptance of the modified EULA. The "Last Updated" date at the top of this page will reflect any changes.

7 Apple App Store Terms

This EULA is between you and POKER VAULT LTD only, not with Apple Inc. Apple is not responsible for the Software or its content. In the event of any conflict between this EULA and the Apple App Store Terms of Service, the Apple App Store Terms of Service shall prevail.

Apple has no obligation to provide maintenance or support for the Software. Apple is a third-party beneficiary of this EULA and may enforce it against you.

8 Governing Law

This EULA shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any disputes arising from this EULA shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be subject to the jurisdiction of the applicable courts.
